By creating an account or using RealtyPhoto.ai (the "Service"), you agree to these Terms, including the Acceptable Use, AI Content & Disclosure, and Refund & Billing sections below, and the Privacy Policy.
RealtyPhoto.ai lets you upload photographs, apply AI-based enhancements and manual adjustments, organize them into projects, and download results. The Service is provided by Almond Tree Media ("we", "us").
You must be at least the age of majority in your province or state, and a resident of Canada or the United States. You are responsible for all activity under your account and for keeping your credentials secure.
You retain all ownership of photos you upload ("Your Content"). You grant us a limited, non-exclusive licence to store, process, transmit, and create enhanced derivatives of Your Content solely to provide the Service to you. We do not claim ownership and we do not use Your Content to train AI models. You represent that you own or have the rights to upload and enhance Your Content.
Enhancements are generated using third-party AI providers; Your Content is transmitted to such providers for processing. AI output may contain errors, artifacts, or alterations — always review every enhanced image before use.
Real-estate boards and regulators (including CREA/REALTOR® rules and provincial bodies) restrict digitally altered listing photos that could misrepresent a property. You are responsible for ensuring enhanced images do not materially misrepresent the property, and for disclosing digital enhancement where your board, MLS, or local law requires it. Do not use the Service to fabricate or conceal material facts about a property.
We may rate-limit, suspend, or terminate accounts that violate this policy, and revoke free credits obtained through abuse.
AI features are metered in credits (1 credit ≈ 1 standard enhancement). Credits purchased in packs and top-ups do not expire while your account is active. Credits included with a subscription reset monthly and stop when the subscription ends. Credits have no cash value and are non-transferable.
Prices are in CAD and exclusive of tax; applicable taxes are added at checkout.
Packs and top-ups are refundable only if no credits from that purchase have been used; once any credit from a purchase is spent, that purchase is non-refundable. Subscriptions can be cancelled anytime — cancellation stops future renewals; you keep access until the end of the paid period. If an enhancement fails for technical reasons on our side, the credit is automatically refunded. Dissatisfaction with AI output is not a basis for a refund. Statutory consumer rights are not affected by this policy.
Projects and files are retained per your plan's retention schedule. You are responsible for downloading and keeping your own copies — the Service is not a backup or archival service.
We and our licensors own the Service, its software, presets/"Mods", and branding. Preset instructions are confidential. You may use enhanced outputs of Your Content freely, including commercially.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, are not liable for indirect or consequential damages, and our total aggregate liability is limited to the amount you paid us in the three months preceding the claim. Nothing limits liability that cannot be limited by law.
You may close your account anytime; we may suspend or terminate for breach. We may update these Terms — material changes will be notified by email or in-app.
